Acceptance
of Terms
These
Terms of Service (the "Terms") are intended to make you aware
of your legal rights and responsibilities with respect to your access to and
use of the ThrillTime website and any other related mobile or software
applications under the brand name ‘ThrillTime’ (collectively "Platform").
Please
read these Terms carefully. By accessing or using the Platform, you are
agreeing to these Terms and concluding a legally binding contract with
ThrillTime, an online platform ("ThrillTime"/"We"/"Us"/"Our").
You may not use the Platform and/or its Services if you do not accept the Terms
or are unable to be bound by the Terms.
By
visiting our Platform and/or purchasing something from us, you engage in our
Services and agree to be bound by these Terms, including any additional terms
and conditions and policies referenced herein and/or available by hyperlink on
the Platform. These Terms apply to all users of the Platform, including users
who are browsers, vendors, customers, merchants, and/or contributors of content
displayed on the Platform.
Your
use/access of the Platform shall be governed by these Terms and the Privacy
Policy as available on the Platform ("Privacy Policy").
These
Terms may be updated from time to time without notice as the Platform is in
development phase. It is therefore recommended that you review these Terms, as
available on the Platform, each time you access and/or use the Platform. In the
event there is any conflict or inconsistency between these Terms and any other
terms and conditions that appear on the Platform, these Terms will prevail.
Definitions
"Customer" or "You" or "Your"
refers to you, as a customer of the Services. A customer is someone who
accesses or uses the Services for the purpose of booking, purchasing, or
availing adventure activities, experiences, and related services.
"Vendor" or "Activity Provider" includes
adventure activity operators, experience providers, tour operators,
entertainment venues, and any other third-party service providers onboarded
with ThrillTime who offer activities such as skydiving, surfing, VR rooms,
kayaking, and other adventure or recreational activities.
Services
Overview
ThrillTime
is an online booking facilitation platform that connects Customers with Vendors
for adventure activities and experiences including but not limited to
skydiving, surfing, VR rooms, kayaking, bungee jumping, rock climbing, water
sports, and other recreational activities ("Services").
IMPORTANT
DISCLAIMER: ThrillTime operates
solely as a booking facilitation platform. We DO NOT provide, operate, or
directly deliver any adventure activities or experiences. All activities are
provided by independent Vendors who are solely responsible for their services,
safety standards, equipment, insurance, age restrictions, medical requirements,
and service delivery.
Services
on the Platform are available exclusively within India.
Platform
Development Phase Notice
Our
Platform is currently in active development phase. During this period:
- Features
may change, be added, or removed without prior notice
- Platform
functionality may experience periodic improvements or modifications
- User
feedback is encouraged and appreciated as we continue to enhance the
Platform
- These
Terms may be updated frequently to reflect Platform developments
- Users
are considered early adopters participating in our Platform evolution
Eligibility
Age
Requirement: You must be at least 18
years of age to create an account and make bookings on the Platform. Persons
under the age of 18 years are not eligible to use/access the Platform
independently.
Parental
Responsibility: If you are booking
activities for participants under 18 years of age, you represent that you are
the parent or legal guardian of such participants and you accept full
responsibility for their participation, including ensuring they meet all
activity-specific age and physical requirements.
Competency
to Contract: Persons who are
"incompetent to contract" within the meaning of the Indian Contract
Act, 1872 are not eligible to use/access the Platform.
Legal
Authorization: If you are using the
Platform on behalf of any person/entity, you represent and warrant that you are
authorized to accept these Terms on behalf of such person/entity. Further, you
and such person/entity agree to be jointly and severally liable for violations
of these Terms.
You
agree to use the Services only in compliance with these Terms and applicable
laws, and in a manner that does not violate our legal rights or those of any
third party.
Account
Registration and Booking Options
Account
Creation (Optional): While account
creation is optional, registered users enjoy benefits including:
- Booking
history and easy rebooking
- Faster
checkout process
- Exclusive
offers and early access to new activities
- Personalized
recommendations
Guest
Booking Available: You may book
activities as a guest by providing:
- Full
name of primary booker
- Valid
mobile phone number
- Email
address for confirmations and communications
Registration
Requirements: If you choose to create
an account, you must:
- Provide
accurate, current, and complete information
- Maintain
and update your information to keep it current
- Keep
your login credentials secure and confidential
- Notify
us immediately of any unauthorized use of your account
By
registering your mobile number with us, you provide your consent to be
contacted by us directly or through third-party service providers via phone
calls, SMS notifications, email, WhatsApp, and/or any other electronic mode of
communication for booking confirmations, activity updates, and promotional
offers.
Activity
Booking Process
Booking
Procedure:
- Browse
available activities on the Platform
- Select
activity, date, and number of participants
- Provide
required participant information and emergency contacts
- Review
age restrictions, safety requirements, and activity terms
- Complete
payment through our secure payment gateway
- Receive
booking confirmation via email and SMS
Price
Transparency: The price displayed at
the time of booking is the final price you will pay. Prices are set by Vendors
and include all applicable taxes and charges unless specifically mentioned
otherwise.
Booking
Confirmation: Booking is confirmed
only upon:
- Successful
payment processing
- Vendor
availability confirmation
- Receipt
of booking confirmation email and SMS
Information
Accuracy: You are solely responsible
for providing accurate participant information, including names, ages, contact
details, medical conditions, and emergency contacts. Incorrect information may
result in denied participation without refund.
Age
Restrictions and Safety Requirements
Vendor
Responsibility: All age restrictions,
medical requirements, and safety guidelines are determined and enforced by
individual Vendors, not by ThrillTime.
Clear
Communication: Age restrictions and
safety requirements are clearly mentioned in activity descriptions and booking
confirmations.
Venue
Verification: Age and medical
requirements are verified by Vendors at activity locations, not during online
booking.
No
Platform Liability: ThrillTime is not
responsible if participants are denied service at venues due to:
- Failure
to meet stated age requirements
- Medical
conditions that prevent safe participation
- Failure
to bring required documentation or equipment
- Non-compliance
with safety protocols
Participant
Acknowledgment: By booking, you
acknowledge that you understand all stated requirements and confirm all
participants meet the criteria.
Payment
Terms and Processing
Payment
Methods: We accept payments through
Razorpay and other secure payment gateways supporting:
- Credit
cards and debit cards
- Net
banking
- UPI
payments
- Digital
wallets
Secure
Processing: All payment information
is processed securely through PCI DSS compliant payment gateways. ThrillTime
does not store complete credit/debit card information.
Platform
Fees: Currently, we do not charge
booking fees or convenience charges. However, we reserve the right to introduce
such fees at any time without appropriate notice to users.
Price
Changes: Activity prices are locked
in at the time of booking and payment. Price changes by Vendors after booking
do not affect your confirmed booking.
Payment
Confirmation: Activities are
confirmed only after successful payment processing and vendor confirmation.
Cancellation
and Refund Policy
Customer
Cancellations:
1.
Eligibility for
Cancellation:

Cancellations are permitted only
if made more than 48 hours prior to the scheduled activity date.
·
All such cancellations remain
subject to the Vendor’s own cancellation policy and confirmation, and may
additionally be accepted or declined at the sole discretion of the Platform.
2.
Late Cancellations: Cancellations made within 48 hours of the scheduled
activity date are non-refundable under all circumstances.
- Refund
Processing: Approved refunds
will be processed within 7–10 business days to the original method of
payment.
Vendor
Cancellations:
- Full
Refund: If a Vendor cancels your
activity for any reason, you will receive a full refund
- Compensation
Credit: In addition to the
refund, we may provide a small compensation credit for future bookings as
an apology for the inconvenience
- Force
Majeure: In cases of natural
disasters, extreme weather, or other force majeure events, full refunds
will be provided
Refund
Processing Method:
- All
refunds are processed directly by ThrillTime
- Refunds
are made to the original payment method used for booking
- Refund
amounts are adjusted from future payments to Vendors where applicable
- Processing
time may vary depending on your bank or payment provider
No-Show
Policy:
- Failure
to appear at the activity location at the scheduled time results in
forfeiture of the entire booking amount
- No
refunds are provided for no-shows or late arrivals that result in missed
activities
Reviews
and Ratings
While
not currently active, we may introduce a review and rating system in the
future. When implemented:
Review
Guidelines:
- Reviews
must be based on actual activity participation
- Reviews
should be honest, fair, and constructive
- Personal
attacks, profanity, or inappropriate content are prohibited
- Reviews
may not be used for commercial purposes or promotion of competing services
Review
Ownership: By submitting reviews, you
grant ThrillTime the right to use, modify, and display your reviews for
promotional and operational purposes.
Moderation
Rights: We reserve the right to
remove, edit, or hide reviews that violate our guidelines or applicable laws.
Prohibited
Activities and User Conduct
You
agree not to use the Platform for any purpose that is:
Illegal
or Harmful:
- Unlawful,
fraudulent, or deceptive activities
- Activities
that violate any applicable laws or regulations
- Harassment,
abuse, or threats against other users or Vendors
- Posting
false, misleading, or defamatory content
Platform
Misuse:
- Attempting
to circumvent Platform security measures
- Reverse
engineering, decompiling, or attempting to extract source code
- Using
automated systems, bots, or scripts to access the Platform
- Creating
multiple accounts to circumvent restrictions or policies
Commercial
Misuse:
- Reselling
activities or bookings for commercial gain without authorization
- Using
the Platform to compete with or duplicate our services
- Harvesting
user information for commercial purposes
- Spamming
or sending unsolicited communications to other users
Booking
Violations:
- Providing
false information during booking process
- Making
bookings with no intention of participating
- Transferring
bookings without proper authorization
- Attempting
to manipulate pricing or availability
Vendor
Relationship and Third-Party Services
Independent
Contractors: All Vendors are
independent contractors operating their own businesses. They are not employees,
agents, or representatives of ThrillTime.
Vendor
Verification: We manually verify
Vendors before listing their activities and maintain agreements outlining
platform and customer safety terms.
Limited
Vendor Information: Only essential
vendor information (name, location, pricing, activity details) is displayed to
customers to maintain privacy and security.
No
Direct Contact: Direct communication
between customers and Vendors is not facilitated through the Platform except in
cases of disputes or grievances requiring resolution.
Vendor
Policies: Each Vendor may have
additional terms and conditions that apply to their services. You are
responsible for reviewing and accepting such terms when participating in
activities.
Customer
Support and Communications
Support
Channels:
- Email
support for booking-related inquiries
- Phone
support during business hours (calls may be recorded for training and
quality purposes)
- Response
time: Email inquiries within 24-48 hours
Communication
Methods:
- Booking
confirmations via email or SMS
- Activity
updates and important notifications
- WhatsApp
notifications for booking updates (if phone number supports WhatsApp)
- Marketing
communications (with your consent – you may opt out anytime)
Support
Limitations:
- We
provide support only for booking-related issues, payment problems, and
platform technical support
- We
do not provide on-site support during activities
- Activity-related
issues must be resolved directly with Vendors at activity locations
- Emergency
support during activities is the sole responsibility of Vendors
Liability
Disclaimers and Limitations
CRITICAL
DISCLAIMER – PLEASE READ CAREFULLY:
NO
LIABILITY FOR ACTIVITIES: THRILLTIME
IS STRICTLY A BOOKING FACILITATION PLATFORM. WE ARE NOT LIABLE FOR ANY
INJURIES, ACCIDENTS, DEATH, PROPERTY DAMAGE, OR ANY OTHER HARM ARISING FROM
PARTICIPATION IN ACTIVITIES BOOKED THROUGH OUR PLATFORM.
VENDOR
RESPONSIBILITY: ALL ACTIVITIES ARE
PROVIDED BY INDEPENDENT VENDORS WHO ARE SOLELY RESPONSIBLE FOR:
- Safety
equipment and safety protocols
- Professional
insurance and liability coverage
- Staff
training and qualifications
- Activity
supervision and risk management
- Emergency
response and medical assistance
- Compliance
with safety regulations and standards
USER
ASSUMPTION OF RISK: BY BOOKING ANY
ACTIVITY, YOU ACKNOWLEDGE AND AGREE THAT:
- Adventure
activities involve inherent risks including risk of serious injury or
death
- You
participate voluntarily and at your own risk
- You
have carefully considered the risks involved
- You
release ThrillTime from any and all liability related to your
participation
PLATFORM
LIMITATIONS:
- We
do not guarantee Platform availability or uninterrupted service
- Technical
issues, maintenance, or system failures may temporarily affect Platform
functionality
- We
are not liable for booking delays or failures due to technical issues
beyond our control
- Platform
downtime requires users to wait until service is restored
MAXIMUM
LIABILITY: TO THE MAXIMUM EXTENT
PERMITTED BY LAW, THRILLTIME’S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR
USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC
BOOKING GIVING RISE TO THE CLAIM, OR INR 5,000, WHICHEVER IS LOWER.
EXCLUSION
OF DAMAGES: THRILLTIME SHALL NOT BE
LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE
DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR USE, EVEN IF ADVISED OF
THE POSSIBILITY OF SUCH DAMAGES.
Force
Majeure and Extraordinary Circumstances
Covered
Events: Neither ThrillTime nor
Vendors shall be liable for delays, cancellations, or failure to perform due to
circumstances beyond reasonable control, including:
- Natural
disasters, extreme weather conditions
- Government
restrictions, emergency declarations
- Terrorism,
civil unrest, or security threats
- Pandemic
or health emergencies
- Infrastructure
failures beyond our control
Refund
Policy: In force majeure situations:
- Full
refunds will be provided for cancelled activities
- Refunds
will be processed as quickly as possible given the circumstances
- Alternative
booking dates may be offered when activities resume
Intellectual
Property Rights
Platform
Ownership: ThrillTime owns all
intellectual property rights in the Platform, including:
- Website
design, layout, and functionality
- Software,
code, and technical systems
- ThrillTime
brand name, logos, and trademarks
- Content
created by ThrillTime (descriptions, marketing materials, etc.)
Vendor
Content: Activity descriptions,
photos, and promotional materials are provided by Vendors and remain their
intellectual property. Vendors grant us license to display this content for
promotional purposes.
User
License: You are granted a limited,
non-exclusive license to access and use the Platform for personal booking
purposes only.
Prohibited
Uses: You may not:
- Copy,
reproduce, or redistribute Platform content
- Use
ThrillTime branding or trademarks without permission
- Create
derivative works based on Platform functionality
- Extract
data from the Platform for commercial purposes
Data
Protection and Privacy
Information
Collection: We collect personal
information necessary for booking facilitation as detailed in our Privacy
Policy.
Data
Sharing: Customer booking information
is shared with relevant Vendors only to fulfill bookings. We do not sell
personal information to third parties.
Data
Security: We implement appropriate
security measures to protect customer information, though no system is 100%
secure.
Marketing
Communications: With your consent, we
may send promotional offers and activity updates. You may opt out at any time.
Data
Retention: We retain booking and
customer data as specified in our Privacy Policy and as required by applicable
laws.
Dispute
Resolution and Grievances
Internal
Resolution: We encourage customers to
contact our support team first for any booking-related issues.
Grievance
Process:
- Submit
grievances within 4 days of the activity date or issue occurrence
- Provide
detailed information about the issue and supporting documentation
- Allow
up to 15 business days for investigation and resolution
- Escalation
to management available if initial resolution is unsatisfactory
Vendor
Disputes: Issues with Vendor services
during activities should be raised with the Vendor on-site, then reported to
ThrillTime within 4 days.
Mediation: Complex disputes may be resolved through mediation
before pursuing legal action.
Legal
Jurisdiction: Any legal disputes
shall be subject to the exclusive jurisdiction of courts in Mathura, India.
Grievance
Redressal Officer
In
accordance with the Information Technology Act, 2000, we have appointed a
Grievance Redressal Officer to address complaints:

any complaints regarding the Platform, booking issues, or terms violations,

Modifications
to Terms and Services
Platform
Development: As the Platform is in
active development, features may be modified, added, or removed to improve user
experience.
Terms
Updates: These Terms may be updated
periodically. Material changes will be communicated via Updated effective date
at the top of these Terms.
Service
Changes: We reserve the right to:
- Modify
Platform features or functionality
- Change
pricing policies or fee structures
- Add
or remove payment methods
- Update
booking processes or requirements
- Discontinue
services with reasonable notice
Continued
Use: Your continued use of the
Platform after Terms updates constitutes acceptance of the revised Terms.
Account
Termination
Termination
by You: You may stop using the
Platform at any time and request account deletion.
Termination
by ThrillTime: We may suspend or
terminate your account if you:
- Violate
these Terms or applicable laws
- Provide
false or fraudulent information
- Engage
in activities harmful to the Platform or other users
- Abuse
customer support or dispute processes
- Fail
to pay for confirmed bookings
Effect
of Termination:
- Access
to Platform features will be removed
- Outstanding
bookings remain valid unless otherwise specified
- Certain
provisions of these Terms survive termination (payment obligations,
liability limitations, etc.)
General
Provisions
Entire
Agreement: These Terms, together with
the Privacy Policy, constitute the entire agreement between you and ThrillTime.
Severability: If any provision of these Terms is deemed invalid or
unenforceable, the remaining provisions shall continue in full force.
No
Waiver: Failure to enforce any
provision of these Terms does not constitute a waiver of that provision.
Assignment: You may not assign your rights under these Terms.
ThrillTime may assign these Terms in connection with a merger, acquisition, or
sale of assets.

Governing
Law and Jurisdiction
These
Terms are governed by the laws of India, including:

Indian Contract Act, 1872

Jurisdiction: Courts in Mathura, India shall have exclusive
jurisdiction over any disputes arising from these Terms.

BE BOUND BY THESE TERMS OF SERVICE. YOU ALSO ACKNOWLEDGE THAT YOU UNDERSTAND
THE RISKS INVOLVED IN ADVENTURE ACTIVITIES AND THAT THRILLTIME IS NOT LIABLE
FOR ANY INJURIES OR DAMAGES RESULTING FROM YOUR PARTICIPATION IN ACTIVITIES
BOOKED THROUGH THE PLATFORM.
Effective

These
Terms of Service are effective as of the date listed above. We encourage you to
review them periodically for any updates. Your continued use of the Platform
constitutes acceptance of any revisions to these Terms.
